Widow Awarded $1.25 Million In Wrongful Death Suit

Jeanette Dooley of Jackson County settled a lawsuit she brought after her new husband was killed driving his truck. Chad Dooley had been employed as a truck driver for eleven years when he and another truck collided on Highway 54 at 4 a.m. in the morning on August 20, 2005. Jeanette settled the lawsuit for $1.25 million but said she would give it all back to have Chad home.

The other truck driver had a green light but was attempting to make a left turn onto an on ramp when he collided with Chad's truck. Chad's truck landed upside down in a ditch, and Chad died in the truck from positional asphyxiation.

Jeanette Dooley's lawyer said part of the reason the settlement went through so quickly was because of the caps on non-economic damages. Jeanette could not recover more than $350,000 for the emotional pain, loss of society and loss of companionship she suffered and will continue to suffer for the rest of her life due to Chad's death. She was however, able to recover for his future lost earnings, which made up a substantial part of the settlement.
