      <title>Drunk Driver Kills 17 Man In Chicago</title>
      <description>&lt;p&gt;Tracy Bolden was drunk and speeding in his van in the Garfield Park neighborhood when he &lt;a href="http://www.nbc5.com/news/15195069/detail.html?rss=chi&amp;psp=news"&gt;rear ended the car Marlon Tate was driving&lt;/a&gt;.  Tate was pronounced dead shortly after the accident.  The passenger of Tate's car, 17 year old Laura Kubiak survived the crash despite the van resting on top of the car after the incident.&lt;/p&gt;&lt;p&gt;Bolden was charged with DUI but the charges may be upgraded to felony charges.  The family of Marlon Tate may be able to file a claim on behalf of Tate for his wrongful death.  Kubiak may also be able to file a claim against Bolden for her injuries.       <title>Commuter Train Kills Man</title>
      <description>&lt;p&gt;&lt;a href="http://www.chicagotribune.com/news/local/chi-southshore_webdec06,1,7259882.story"&gt;Charles Jones &lt;/a&gt;was killed the morning of December 5, 2007 after his truck became stuck on a patch of ice on a train crossing in Gary, Indiana.  Jones vehicle was struck by a South Shore Line train.  It is being reported that the gates were down at the time of the accident, but Jones decided to drive around the gates causing his truck to become stuck on the tracks when the train was passing.&lt;/p&gt;&lt;p&gt;Train accidents in Chicago and around the country have been in the news quite often in recent years sometimes due to people going around gates but also sometimes due to gates not properly working or crossing not being clearly marked.  People should always be alert around train crossings but it is important train crossings are safe.       <title>Wrong Prescription Leads to Miscarriage</title>
      <description>&lt;p&gt;Chandra and Courtenay Givens filed a &lt;a href="http://www.myfoxstl.com/myfox/pages/News/Detail?contentId=4668699&amp;version=1&amp;locale=EN-US&amp;layoutCode=TSTY&amp;pageId=3.2.1"&gt;lawsuit against Walgreens &lt;/a&gt;after Chandra was allegedly given the wrong prescription, which led to her miscarrying.  Walgreens, a Deerfield, Illinois based pharmacy chain, has been accused of giving out wrong prescriptions in the past.  These mis-filled prescriptions can lead to serious health problems, including death.&lt;/p&gt;&lt;p&gt;Chandra Givens was prescribed a pre-natal vitamin but she received Matulane, a chemotherapy drug.  The drug causes problems with cell growth and DNA development.  Givens filed a wrongful death and medical malpractice suit against Walgreens and is asking for medical expenses as well as damages for the lost life of her unborn child.       <title>Minneapolis Bridge Death Toll Stands at 13</title>
      <description>&lt;p&gt;On Monday the &lt;a href="http://www.nbc5.com/news/13943191/detail.html?rss=chi&amp;psp=news"&gt;last known missing person's body &lt;/a&gt;was pulled from the water where the Minneapolis Interstate 35W bridge once stood.  Gregory Jolstad was a 45 year old construction worker that died in the collapse.  He was part of the bridge's resurfacing crew.  The official death toll now stands at 13.&lt;/p&gt;&lt;p&gt;The bridge collapse has raised a lot of questions and concerns about bridge construction around the country.  Many of the victims of the Minneapolis bridge collapse are looking for answers from those in charge of the maintenance and safety of the bridge but are not getting the answers they would like.  People injured in the collapse and families of those killed may have a right to recover against the city and others in charge of maintaining the bridge.       <title>Com Ed Work Dies in Chicago Suburb</title>
      <description>&lt;p&gt;Daniel Yost was working on overhead power lines in Lombard, Illinois when he was &lt;a href="http://www.nbc5.com/news/13949727/detail.html?rss=chi&amp;psp=news"&gt;electrocuted&lt;/a&gt;.  The 24 year old Yost was working near 135 S. Dodge Lane in Lombard on Tuesday afternoon.  He was taken to Advocate Good Samaritan Hospital but did not survive.  &lt;/p&gt;&lt;p&gt;ComEd and the Lombard police are currently investigating the matter.  Yost's family may be able to recover for his wrongful death.       <title>Chicago Area Man Killed by Freight Train</title>
      <description>&lt;p&gt;Thomas Bujnowski was only 47 years old when he died Friday morning.  Bujnowski's body was found near the train tracks at Route 14 and Lincoln Street in Fox River Grove, Illinois.  It is believed Bujnowski was &lt;a href="http://www.nbc5.com/news/13938183/detail.html?rss=chi&amp;psp=news"&gt;hit by a Union Pacific freight train&lt;/a&gt;.  His death has been ruled an accident but there is an ongoing investigation.  &lt;/p&gt;&lt;p&gt;Police hope to find additional answers to how Thomas Bujnowski was killed and to determine if the train operator or train line was at fault for the accident.       <title>Rescue Efforts Halted in Utah Mine Collapse</title>
      <description>&lt;p&gt;&lt;a href="http://www.cnn.com/2007/US/08/20/mine.unstable/index.html"&gt;Digging has been halted &lt;/a&gt;at the Crandall Canyon coal mine after 3 rescue workers recently died and six others were injured.  Experts have examined the mine and say it is too dangerous to continue digging.  The head of the federal Mine and Safety Health Administration, however, has said that if there are any signs of life they will continue rescue efforts.  &lt;/p&gt;&lt;p&gt;Four holes have now been dug into the mine in search for Luis Hernandez, Manuel Sanchez, Kerry Allred, Carlos Payan, Brandon Phillips and Don Erickson.  There has been no sign of life but friends and family are stilling hoping the miners are found alive.  Reports have varied on whether the air quality is enough to sustain life in the mine.  &lt;/p&gt;&lt;p&gt;The mine owner has repeatedly stated that seismic activity caused the mine to collapse, but no seismic activity has been reported.  Many problems with the mine had been reported in the past.       <title>TASER Death, Lawsuit Settled $100,000</title>
      <description>&lt;p&gt;Ray Charles Austin died in September 2003 after he was shocked by a Taser several times.  Austin was an inmate in the Gwinnett County Jail at the time of his death.  Austin was shocked as a result of a fight he was engaged in where he bit part of a deputy's ear off.&lt;/p&gt;&lt;p&gt;Austin's family &lt;a href="http://www.firstcoastnews.com/news/georgia/news-article.aspx?storyid=89159"&gt;settled the suit for $100,000 &lt;/a&gt;and agreed not to make public statements about the settlement.  The agreement for confidentiality is an ongoing trend in settlements.  Defendants do not want the public to see what they are paying for these cases and they do not want the public to know that they were at fault.       <title>Chicago Man Killed While Riding Bicycle</title>
      <description>&lt;p&gt;Ryan Boudreau of Chicago died Monday after being &lt;a href="http://www.chicagotribune.com/news/local/chi-bicycleaug14,1,311622.story"&gt;hit by a truck&lt;/a&gt;.  Boudreau, who was 27 at the time of his death, was riding his bicycle on Clark Street in Chicago when he was hit by the truck.  He was pronounced dead at the scene.&lt;/p&gt;&lt;p&gt;Officers have determined the fatal collision was an accident.  However, Boudreau's family may be able to recover against the truck driver for the wrongful death of Boudreau if it is determined that the driver caused the accident.       <title>Family Awarded $35.3 Million After Father's/Husband's Death</title>
      <description>&lt;p&gt;A jury awarded the family of Danny Oppenheim Jr. $35.3 million.  Danny Oppenheim died after his &lt;a href="http://www.dailytribune.com/stories/072907/loc_order001.shtml"&gt;doctors failed to properly monitor &lt;/a&gt;him during surgery.   While he was under anesthesia he was not receiving the proper amount of oxygen.  The lack of oxygen caused brain damage and eventually Oppenheim's death.  &lt;/p&gt;&lt;p&gt;The two doctors, Aeneas Guiney and Robert Wolf have had other patients become severally ill under there watch and at least one other patient die.  Their licenses were suspended in November 2006 after a second patient in their care died.  &lt;/p&gt;&lt;p&gt;This lawsuit is an example of why doctors need to be held accountable for their actions.  They should not be allowed to hide behind state imposed caps on damages.  The family of Danny Oppenheim deserves what the jury found adequate to award them.  They, as well as other families, should not have to worry about state imposed caps on damages.
