A Bridgeview man was killed on Saturday after his motorcycle crashed into a truck. Joseph Suski was 49 years old when he died. He was wearing a helmet but still suffered fatal injuries. The driver of the truck was not injured.

The reports at this time do not indicate if the accident that caused Suski's death was his own fault or the fault of the driver of the truck. The accident occurred on the Frontage Road between Black Road and Illinois Route 52. Suski's family may have a claim of wrongful death against the man driving the truck if he is found to be at fault for the accident.

What type of claim would the driver of the truck have if the accident was the motorcyclists fault? Besides living with the situation for the rest of his/her life!

Ann:

If the accident was the motorcyclist's fault, the truck driver would have a claim against the motorcyclist for any damage his truck suffered and any injuries he suffered as a result of the accident.

If, however, the truck driver was found at fault, the motorcyclist's estate would have a claim on behalf of the motorcyclist for his wrongful death. A person bringing this type of claim may seek various money damages, including but not limited to, loss of society to the family, loss of consortium to a spouse, economic loss and medical bills.

What type of liability or wrongful death lawsuit would the family of Mr. Suski have if it were found that a friend not only caused Mr. Suski to crash before the impact of the truck, but also then proceeded to run him over and then flee the scene?
