Louis Killingworth was only 16 years old when he died Wednesday afternoon. Killingworth was crossing West Garfield Boulevard at South LaSalle Street Wednesday morning when a van driven by Jimmy Scurlock turned the corner and took Killingworth's life. The 16 year old boy was rushed to Stroger Hospital but was pronounced dead Wednesday afternoon.

Scurlock was ticketed for the accident and for driving without insurance. It is unknown at this time whether he had insurance on the van but did not have proof at the scene. Killingworth's family may be able to take legal action against Scurlock, but if he does not have insurance, it may be difficult for them to collect if there is a judgment entered against Scurlock.

In Illinois it is mandatory for driver's to have automobile insurance and tragedies like this accident remind us why it is so important. When someone is injured or killed in an accident they have a right to recover against the person at fault. However, if there is no insurance, it is very difficult for a victim to recover any money because the person responsible may very well have insufficient funds to cover the judgment. If you have been injured in an automobile accident contact an attorney to find out more about your rights and what you may be able to recover from the responsible party.
